Terms of Service

1. Agreement

These Terms are a binding agreement between you and Avinyaa EdTech Private Limited (“Avinyaa,” “we,” “us,” or “our”) for your use of Vibe. We may update these Terms by posting a revised version; continued use after changes means you accept them.

2. The Services

Vibe provides an AI-assisted generation studio for multi-file frontend (and related) projects, including live preview URLs. We grant you a non-exclusive, non-transferable, revocable license to use the Services for your personal or internal business purposes, subject to these Terms.

3. Accounts

Access to certain features requires signing in with a supported identity provider (such as Google, Microsoft, or Apple). You are responsible for activity under your account and for keeping your linked identity secure. Notify us promptly of unauthorized use.

4. Content and generated code

Your prompts: You retain rights in prompts and materials you submit (“User Content”).

Generated output: You own the code and apps Vibe generates from your User Content (“Generated Output”). You are responsible for reviewing, securing, and deploying that output.

Commercial use: Generated Output created while you have an eligible paid plan may be used commercially. Ending the plan does not revoke that right. Third-party software, assets, and model outputs remain subject to their own licenses and restrictions.

License to Vibe: You grant us a worldwide, royalty-free license to process User Content only as needed to operate and improve the Services. We do not use your private User Content or Generated Output to train generalized foundation models.

5. Acceptable use

You agree not to use the Services to:

• Generate malware or intentionally harmful software
• Infringe others' intellectual property or privacy rights
• Violate applicable law
• Attempt unauthorized access to our systems or other users
• Scrape or systematically extract data without permission

6. Subscriptions and payments

Paid plans are billed in advance. Pricing, credit allowances, and payment terms are shown at checkout and may change with reasonable notice. Non-payment may result in suspension or termination.

Credits measure eligible AI usage. Free credits are a one-time grant. Paid plans receive their stated allowance once per billing period; unused paid-plan credits may roll over for one additional period, up to that plan's monthly allowance. Purchased credit packs and billing activation are subject to the checkout terms shown at purchase.

Each project receives one stable preview URL for its latest saved version. Previews may pause when idle, and availability is not guaranteed as permanent hosting.

7. Disclaimers

THE SERVICES AND GENERATED OUTPUT ARE PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND. VIBE DOES NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION. AI OUTPUT MAY BE INCOMPLETE OR INSECURE—YOU MUST REVIEW BEFORE DEPLOYMENT.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AVINYAA, VIBE, AND THEIR TEAM ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM USE OF THE SERVICES OR GENERATED OUTPUT. OUR TOTAL LIABILITY FOR CLAIMS RELATED TO THE SERVICES IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM.

9. Termination

We may suspend or terminate access if you breach these Terms or for operational reasons. Upon termination, your right to use the Services ends immediately.

10. Governing law

These Terms are governed by the laws of India, without regard to conflict-of-law principles. Any disputes arising from these Terms or the Services will be subject to the exclusive jurisdiction of the courts in Surat, Gujarat, India.
